*CLEAR THE AIR / RETIRE YOUR RIDE PROGRAM PRIVACY POLICYThe Retire Your Ride program (“RYR” or the “Program”) is Canada’s national vehicle scrappage program. RYR
is coordinated by the Clean Air Foundation (“CAF”) with financial
support from the Government of Canada. Through RYR, members of the
public are encouraged to retire their 1995 model year and older motor
vehicles for environmentally responsible recycling; in return for
recycling their vehicles, Program participants (“Participants”) receive
various incentives and premiums. Although
CAF is the national coordinator of the program, the actual functions of
the Program are provided across the country through a network of
different organizations with different functions: provincial
administrators (“Provincial Administrators”) coordinate the delivery of
the RYR program in the various provinces and territories and distribute
incentives to Participants; call centres (“Call Centres”) are the main
points of telephone contact directly with Participants in the Program;
vehicle recyclers (“Recyclers”) will retrieve and recycle Participants’
vehicles; incentive providers (“Incentive Providers”) furnish the
incentives which are given to Participants; and depending on the
province, charitable organizations (“Charities”) may receive a
charitable donation and provide a charitable receipt based on the value
of donated vehicles. Provincial Administrators and Call Centres are the same organizations in certain provinces. Collectively, these organizations are referred to as the “RYR Network” or “We”. A current list of the organizations in the RYR Network is available online at www.retireyourride.ca. A
written copy may also be obtained by contacting the RYR Privacy Officer
at the address or telephone number given in this Privacy Policy. Each
organization in the RYR Network recognizes the importance of privacy
and is committed to maintaining the accuracy, confidentiality and
security of your personal information. This Privacy Policy describes
the personal information that is collected from you by RYR and the
various organizations within the RYR Network, how RYR Network
organizations manage that personal information, and how that personal
information is used. Each organization
within the RYR Network is responsible for the personal information that
that organization collects, and stores and uses. To ensure
accountability and ease of access in this regard, the organizations in
the RYR Network have designated a single Privacy Officer to oversee
compliance by the RYR Network with this Privacy Policy. The contact
information for our Privacy Officer may be found towards the end of
this Privacy Policy. Although you will
encounter different specific organizations within the RYR Network as a
Participant in the program, all organizations are required to act in
accordance with this Privacy Policy, and your personal information will
never be used or disclosed in a way not described in this Privacy
Policy. 1. Contact with the RYR Network Participants in the Program will deal with different organizations in the RYR Network. This section of the Privacy Policy describes the different organizations that Particpants will encounter. The
first contact with the program will either be with a Call Centre by
telephone or in writing, or with CAF on the Program’s website. Each
province and territory has one Call Centre servicing it; you may find
the Call Centre for your province on the list of RYR Network
organizations as described above. After
you sign up for the Program through CAF or your provincial Call Centre,
your vehicle will be assigned to a Recycler for retrieval and recycling. There
are typically a large number of Recyclers operating in each province
but one since Recycler will be assigned by your provincial Call Centre
to collect and process your vehicle After
your vehicle is recycled, your will receive your chosen incentive(s),
either from the Provincial Administrator for your province, or your
Provincial Call Centre, or directly from the Incentive Provider. Your provincial Call Centre will advise you which Incentive Provider will be providing your incentive. In
addition, if Charities are part of the Program in your province, you
may receive a charitable receipt, either from your chosen Charity
directly, or from the Provincial Administrator, or from your province’s
Call Centre. Your provincial Call Centre will advise you which Charity,
if applicable, will be providing your charitable receipt. 2. What is Personal Information? For
the purposes of this Privacy Policy, personal information is any
information about an individual that allows that individual to be
identified. Personal information does not include anonymous or
non-personal information (i.e., information that cannot be associated
with or tracked back to a specific individual). 3. Why Do We Collect Personal Information? Personal
information is collected for the RYR program first and foremost to
enable the RYR Recyclers to retrieve and recycle the vehicle which you
wish to retire, and to provide you with the incentives which you are
entitled to as a Participant in the Program. We also
collect personal information to monitor the progress, reach and
effectiveness of the RYR program, to further its public outreach,
engagement, and education commitments, as well as to establish,
maintain and manage our relationship with you. Some information is
collected to satisfy the requirements of the Canada Revenue Agency (“CRA”) and/or, for Participants in the province of Québec, Revenu Québec.. 4. What Personal Information do we collect? We
collect and maintain different types of personal information about
individuals with whom we interact which is relevant for purposes that a
reasonable person would consider appropriate and necessary for the
relationship between a donor to and participant in an environmental
program, and the providers and administrators of the program. This may include some or all of the following:

Contact and identification information, such as your name, address, telephone number, fax number, and e-mail address;

Information
regarding the make, model and vehicle information number (VIN) of the
vehicle which is to be recycled, as well as vehicle insurance and
provincial registration information;

Name of spouse or partner if participation in the program is joint;

As much of our communication is in either English or French, not bilingual, we also collect your preferred language;

Product- and service-related information concerning the incentives or rewards you have elected to receive;

Other
personal information to be used for purposes that a reasonable person
would consider appropriate and necessary to provide a vehicle scrappage
program.
5. How do we collect your Personal Information? RYR Network organizations collect your personal information directly from you in a number of ways. Most of your personal information will be collected at the time you register for the Program. There
are two ways to register and therefore two ways in which your personal
information will be collected: over the internet through the Program’s
website which is maintained by CAF, or by contacting a Call Centre by
telephone or in writing. If you register through the
Program’s website, you will provide your personal information to CAF
through the web form on the Program website. If you
contact the Call Centre for your province or territory, you will
provide your personal information to that Call Centre via telephone or
in writing. In addition, the Recycler which
is assigned to retrieve and recycle your vehicle will collect some
personal information to confirm your identity and the identity of the
vehicle which is being collected. No RYR
Network organization will collect personal information about you from
an entity outside the RYR Network without your consent. If you do give
such consent, the source of such personal information will be indicated
in your file. By registering as a Participant in the
Program, you are giving your consent to RYR Network organizations
collecting personal information regarding you or your vehicle from
vehicle registries and personal property security and liens registries. RYR
Network organizations may also collect your personal information
without your knowledge or consent where we are permitted or required to
do so by law. 6. How do we Use Your Personal Information? RYR
Network organizations will not, without your consent, use your personal
information for any purpose other than as described in this Privacy
Policy, except where permitted or required by applicable law or
regulatory requirements. Recyclers will use your personal information
to enable them to retrieve and recycle retired vehicles. Incentive Providers will use your personal information to provide you with the incentives or rewards you are entitled to. If
Charities are involved in the RYR program in your province, Charities
will use your personal information to provide you with a charitable
receipt based on the recycled value of your vehicle. CAF,
Call Centres and Provincial Administrators will use your personal
information to facilitate the other aspects of your participation in
the RYR program, to respond to requests for information and to
periodically keep you informed and up to date on RYR program activities
and other programs conducted by RYR Network organizations In
addition, CAF, the Provincial Administrator and Call Centre for your
province, and the Incentive Providers, Charities and the Recycler with
which you have had direct contact as a Participant in the Program may
use your personal information to send you updates, newsletters, service
announcements relating to the website and to invite you to participate
in surveys or contests. You may however at any times request that any
RYR Network organization not send such messages to you by communicating
with the Privacy Officer for your region or with that organization. RYR
Network organizations may also use your personal information without
your knowledge or consent where we are permitted or required to do so
by law. 7. When do we Disclose Your Personal Information? The
personal information you provide as a participant in the Program will
never be sold or provided to any organization other than CAF, the
Provincial Administrator and Call Centre for your province, and the
Incentive Providers, Charities and the Recycler with which you have had
direct contact as a Participant in the Program. In
particular, in order to effectively administer the Program, your
personal information will be shared between RYR Network organizations
as and their employees as described below. This sharing
of personal information is necessary in order to establish, maintain
and manage the relationship of RYR Network organizations with you. The
personal information you provide when you sign up as a Participant will
be shared between CAF and the Provincial Administrator and Call Centre
for your province, to allow CAF to administer the national program, the
Provincial Administrator to manage the Program in your province and the
Call Centre to coordinate the recycling of your vehicle and the
provision of incentives. Certain personal
information will be disclosed by CAF and/or the Provincial
Administrator and the Call Centre for your Province to the Recycler
assigned to you and which will retrieve and recycle your vehicle. The
personal information which is collected by the Recycler will be
disclosed to CAF to allow your incentive entitlement to be processed. Certain
personal information will be disclosed by CAF and/or the Provincial
Administrator and the Call Centre for your Province to the applicable
Incentive Providers to allow the Incentive Provider to issue your
incentive entitlement. Certain personal
information will be disclosed by CAF and/or the Provincial
Administrator and the Call Centre for your Province or by the Recycler
assigned to you to the Charity which will provide your charitable
receipt, if applicable. In addition, third
party service providers may be engaged by these RYR Network
organizations to perform a variety of functions, such as to mail our
brochures, to process donations, to fulfill your incentive or reward
entitlement or to provide technical services for our website. These
third party suppliers have access to personal information only if
needed to perform the functions for which they are retained. We always
direct that such third party suppliers may only use any personal
information provided to them for the purpose of performing their roles
and may not retain it or use it for any other purpose. In these cases,
where the information is transferred to a third party, RYR will demand
reasonable assurance that the third parties will protect your
information in conformity with our privacy practices. RYR will not
otherwise disclose your personal information for purposes other than
those for which it was collected, except as may be permitted or
required by law, or with your consent. If you
participate in the program by retiring your vehicle through the
Program, certain RYR Network organizations may be required, by law, to
maintain and/or transmit certain elements of your personal information
for tax purposes. They may also use or transmit such information for auditing purposes or surveys . RYR
Network organizations may also disclose your personal information
without your knowledge or consent where we are permitted or required to
do so by law. 8. Consent We
only collect, use, or disclose your personal information when we have
your consent to do so—this commitment is important to us. Depending on
the sensitivity of the personal information, your consent may be deemed
(using an opt-out mechanism) or express. Express consent may be
obtained from you orally, electronically or in writing. Typically,
we will seek your consent at the time that we collect the personal
information. In certain circumstances, your consent may be obtained
after collection but prior to its use or disclosure. If we plan to use
or disclose your personal information for a purpose not previously
identified, we will advise you of this purpose before such use or
disclosure. If you have contacted any RYR Network organization prior to 1 January 2009,
those organizations may, depending on the previous interaction, have
your personal information in their databases. Unless you advise those
specific RYR Network organizations to remove your personal information,
the organizations will continue to use the personal information they
have collected in the manner and for the purposes for which the
information was originally collected. You may
change or withdraw your consent to the use of your personal information
at any time, subject to legal or contractual restrictions and
reasonable notice, by contacting the Privacy Officer for your region at
the address indicated in this Privacy Policy. However, in some
circumstances, a change in, or withdrawal of consent may severely limit
your ability to participate in the Program or our ability to provide
incentives or rewards to you, or make your participation impossible. 9. Where is Your Personal Information Stored? How do You Access or Modify It? Your
personal information will be stored on a proprietary computer database
maintained by CAF (the “Program Database”) at address as listed on the
RYR Network organization list. CAF, the Provincial
Administrator and Call Centre for your Province, the Incentive
Providers which provide your chosen incentives, the Charity which will
process your charitable receipt, if applicable, and the Recycler which
will retrieve and recycle your vehicle will access your personal
information using the Program Database, and may also maintain copies of
such information at their respective addresses as listed on the RYR
Network organization list. Each
RYR Network organization is solely responsible for the proper
collection, maintenance, use and disclosure by it, in accordance with
the Privacy Policy, of any and all Personal Information. Each RYR
Network organization is committed to maintaining physical, electronic
and procedural safeguards that are appropriate to the sensitivity of
your personal information. These safeguards are designed to prevent
your personal information from loss and unauthorized access,
modification or disclosure. Modifying your Personal Information Since
RYR Network organizations use your personal information to contact you,
it is important that the personal information contained in your file is
both accurate and current. If your personal information changes during
the course of our business relationship, you are responsible for
informing the Privacy Officer for your region of such changes. At
any time, you may make a request to view the personal information that
CAF or any other RYR Network organization hold regarding you. If you
wish to review, verify, obtain a copy, update or correct your personal
information, or if you wish to deposit a written comment in your file,
we invite you to contact the office of our the Privacy Officer for your
region at the address and telephone number indicated in this Policy. When
you contact the Privacy Officer, the Privacy Officer will collect
certain information from you to enable your personal information held
by RYR Network organizations to be located and provided to you. You may
consult and/or modify your personal information free of charge, but a
reasonable fee will apply for photocopies and mailing of documents; you
will be advised of the the approximate cost of any photocopies and
mailing you request at the time you make the request. You
may also, in certain circumstances, request that any or all RYR Network
organizations delete part or all of your personal information, if such
information is no longer needed for the purpose for which it was
collected. Such a request will be responded to within 30 days. When
you verify, correct or update your personal information, deposit a
written comment in your file or request than certain information be
deleted, the Privacy Officer for your region will advise the other RYR Network organizations which hold your personal information without delay, unless you request otherwise. 10. RYR Websites When
you visit RYR’s website, registration is not a precondition to access.
However, by visiting the site, you may be identified by your IP address
and cookies, or small data files, will be sent to your computer through
your browser. The only other personal information that we collect and
store via the Web site is that information which you knowingly provide
to us by corresponding with our employees via e-mail, or by making an
on-line application. Non-personal
information, such as the name of the domain from which you access the
Internet, the dates and times you access our Web site and the Internet
address of the Web site from which you may be linking directly to our
Web site, is collected and used to determine the volume of traffic on
our Web site. This information also enables us to identify ways in
which our Web site can be improved to serve you better. The
security of personal information is a high priority for the RYR
program. The RYR Web sites and all associated data are maintained with
technical, administrative and physical safeguards to protect against
loss, unauthorized access, misuse, modification and improper
disclosure. All underlying machines and firewalls at network access
points have restricted access. While no computer system can ever be
fully protected against every possible hazard, RYR Web sites have
reasonable and appropriate security controls to protect the sites and
their information. RYR Web sites may
contain links to other Web sites that may be subject to less stringent
privacy standards. RYR administrators and service providers cannot
assume any responsibility for the privacy practices, policies or
actions of the third parties that operate these Web sites. You should
review the privacy policies of these Web sites before providing them
with personal information. By using any RYR Web site, you signify your consent to the portion of this Privacy Policy dealing with RYR’s Websites. 11. Inquiries, Concerns and Requests for Access If
you have any questions about this Privacy Policy or wish to review,
verify, obtain a copy, update or correct your personal information or
if you wish to deposit a written comment in your file or a request to
delete such information, please contact the office of the Privacy
Officer for the region in which you live. Please note that all requests
