The Clear the Air! program (hereafter called the "Program") is the Quebec-based vehicle scrapping program. This program is co-ordinated by the Association québécoise de lutte contre la pollution atmosphérique (AQLPA) with financial support from the Quebec government. As part of this program, members of the public are encouraged to retire their 1999 model year or older motor vehicles for environmentally responsible recycling; in return for recycling their vehicles, Program participants (hereafter called the "Participants") receive various incentives and premiums.
The AQLPA administers and co-ordinates the Program, whose call centre (hereafter called the "Call Centre") is the main point of direct telephone contact with Program Participants.
Vehicle recyclers (hereafter called the "Recyclers") retrieve and recycle Participants’ vehicles.
Incentive providers (hereafter called the "Incentive Providers") propose and provide the incentives given to Participants entitled to these in exchange for their old vehicle.
The AQLPA recognizes the importance of protecting privacy and is committed to maintaining and guaranteeing the accuracy, confidentiality and security of your Personal Information.
The AQLPA is responsible for the Personal Information it collects, stores and uses as part of the Program.
1. Interaction with the AQLPA and Its Partners
After you sign up for the Program via its Web site or Call Centre, a Recycler will be assigned to retrieve and recycle your vehicle.
Though there is a large number of Recyclers operating in Quebec, only one will be designated by the Call Centre to retrieve and recycle your vehicle.
Once your vehicle has been recycled, your will receive your chosen incentive(s), either from the Call Centre or directly from the Incentive Provider. Your Call Centre will advise you which Incentive Provider will be providing your incentive(s). In addition, you will receive an income tax receipt for your contribution to a charitable organization.

The AQLPA collects Personal Information first and foremost in order to enable Program Participant Recyclers to retrieve and recycle the vehicle you wish to retire, and to provide you with the incentives to which you are entitled as a Program Participant. We also collect Personal Information in order to:

4. What Personal Information Do We Collect?
We collect and maintain various types of Personal Information about individuals with whom we interact which is relevant for purposes that a reasonable person would consider appropriate and necessary for the relationship between a donor to and participant in an environmental program, and the program’s providers and administrators. 5. How Do We Collect Your Personal Information?
The AQLPA collects your Personal Information directly from you in several ways. Most of your Personal Information will be collected upon your subscription to the Program. There are two ways to register, and therefore two ways in which your Personal Information will be collected: over the Internet through the Clear the Air! Web site, or through a Call Centre by telephone. If you register through the Program’s Web site, you will provide your Personal Information to the AQLPA through the Web form on the Program Web site. If you contact the Call Centre, you will provide your Personal Information to the Call Centre via telephone or in writing. In addition, the Recycler assigned to retrieve and recycle your vehicle will collect some Personal Information to confirm your identity and that of the vehicle being recycled.
By registering as a Participant in the Program, you are accepting that the AQLPA confirm Personal Information regarding yourself or your vehicle with the vehicle registry and the personal property, securities and liens registry.
6. How Do We Use Your Personal Information?
The AQLPA will use your Personal Information to facilitate the other aspects of your participation in the Program, respond to requests for information, and periodically keep you informed and up to date on Program activities and other programs conducted by the AQLPA. In addition, the AQLPA, the Incentive Providers, the Quebec branch of the Canadian Kidney Foundation and the Recycler with which you have had direct contact as a Program Participant may use your Personal Information to send you updates, press releases, newsletters, service announcements, and invitations for you to take part in surveys or contests. You may, however, at any time request that any one or other of these organizations stop sending such messages to you. The AQLPA may also use your Personal Information without your knowledge or consent where applicable laws require it to do so.
7. When Do We Disclose Your Personal Information?
The Personal Information you provide as a Program Participant will never be sold or provided to any organization other than the AQLPA, the Incentive Providers, the Quebec branch of the Canadian Kidney Foundation and the Recycler with which you have had direct contact as a Program Participant. In addition, the AQLPA may commission third party service providers to perform various tasks, such as mail our brochures, process donations, fulfill your incentive or reward entitlement, or provide technical services for our Web site. These third party suppliers have access to your Personal Information only if needed to perform such tasks, and cannot retain or use it for any other purpose.
In these cases where your Personal Information gets transferred to a third party, the AQLPA will require from said third party a reasonable guarantee that it will protect your Personal Information in compliance with our privacy practices. The AQLPA will not otherwise disclose your Personal Information for purposes other than those to which you consented or for which it was collected, except as may be permitted or required by law. If you participate in the Program, it is possible that some of our partner organizations use or transfer your Personal Information for auditing purposes or surveys. In addition, the AQLPA may also use your Personal Information without your knowledge or consent where applicable laws require or allow it to do so.
It is important for us to collect, use or disclose your Personal Information only when we have your consent to do so. Depending on the Personal Information’s sensitivity, your consent may be implied (using an opt-out mechanism) or express. You may provide your express consent orally, electronically or in writing. Typically, we will seek your consent at the time we collect your Personal Information. In certain circumstances, we will seek your consent after collection of your Personal Information, but prior to its use or disclosure. If we plan to use or disclose your Personal Information for a purpose not previously identified, we will advise you of this purpose before such use or disclosure.
If you contacted any AQPLA partner organization prior to April 1, 2011, these partner organizations may, depending on the previous interaction, have retained your Personal Information in their databases. Unless you advise those specific partner organizations to remove your Personal Information from their databases, they will continue to use the Personal Information they have collected in the manner and for the purposes for which said Personal Information was originally collected. You may change or withdraw your consent to the use of your Personal Information at any time, subject to legal restrictions. However, in some circumstances, a change in or withdrawal of consent may severely restrict your ability to participate in the Program or our ability to provide you with the incentives or rewards you are entitled to, or make your participation impossible.

Since AQPLA partner organizations use your personal information to contact you, it is important that the Personal Information contained in your file be both accurate and current. If your Personal Information changes during the course of our business relationship, you are responsible for informing us of such changes. You may make a request at any time to view your Personal Information retained by the AQLPA or any of its partner organizations. If you wish to review, verify, update, correct or obtain a copy of your Personal Information, or if you wish to deposit a written comment in your file, we invite you to contact the office of the Privacy Officer for your region at the Call Centre’s address and telephone number. When you contact an agent at the Call Centre, (s)he will collect some information from you to enable your Personal Information held by the AQLPA or its partner organizations to be located and provided to you.
You may query and/or modify your Personal Information free of charge, but a reasonable fee will apply for photocopies and mailing of documents; at the time you make the request, you will be advised of the approximate cost of any photocopies and mailing. You may also, in certain circumstances, request that any or all of the AQLPA’s partner organizations delete part or all of your Personal Information, if said Personal Information is no longer needed for the purpose for which it was collected. Such a request will be responded to within 30 days. When you verify, correct or update your Personal Information, deposit a written comment in your file or request deletion of certain information, the Call Centre agent will advise the other AQPLA partner organizations holding your Personal Information without delay, unless you request otherwise.
11. RYR Web Sites
When you visit the Clear the Air! Program’s Web site, your registration is not a prerequisite condition to access. However, by visiting the site, you may be identified by your IP address and cookies, or small data files, that will be sent to your computer through your Web browser. The only other Personal Information we collect and store via the Web site is that information which you knowingly provide to us by corresponding with our employees via e-mail or by subscribing to the Program on line. Non-personal information, such as the name of the domain from which you access the Internet, the dates and times at which you access our Web site, and the Internet address of the Web site from which you may be linking directly to our Web site, is collected and used to determine the volume of visitor traffic on our Web site. This information also enables us to identify ways in which we can improve our Web site to serve you better.
